Apple Notarizing error: "Couldn't Communicate with a helper Application.

ran across this error today and spent like an hour trying to figure out what the issue was...thought I'd post the solution to save someone else the headache! if you are getting this error it's probably one of 2 things and it ended up being both in my case...

1. there's a new developer agreement/agreements you need to accept
2. your apple developer yearly fee is due
